Federal Judge Orders Release of Abrego Garcia from Immigration Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.

"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his return to the United States to answer human smuggling allegations, he was held in immigration detention.

In her decision, the judge noted that the authorities does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The court proceedings center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this allegation.
