The NBA legend Testifies He Felt No Fear of Nascar in Antitrust Trial

The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Financial Stakes and a Competitive Drive

The owner disclosed financial and corporate details of his 23XI team, revealing he invested $40 million of his own funds into the Nascar Cup series team co-founded with partner Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. I felt as far as the sport required examination from a different view.”

Central Issue: Franchise System and Renewal Demands

The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other professional sports with independent franchises, such as the Charlotte Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan testified for about sixty minutes and exited the courthouse to a media frenzy, with fans and media clamoring for a view or a photo of the sports legend.

Leading the Legal Charge

Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan said is breaking the law to maintain excessive control.

For Jordan and and a fellow team representative, who testified before Jordan, are events from last September. She recounted a hectic and tense period where the sanctioning body informed teams they had to sign a contract extension. The document spanned over a hundred pages detailing team compensation and a guaranteed entry in Nascar-sponsored races.

Choosing Litigation

Jordan explained that 23XI and Front Row Motorsports decided their only feasible option was to decline to sign that extensive document and litigate the matter. All other teams signed the agreement.

Jordan and co-owner Denny Hamlin approached Nascar about possible changes or negotiations. Nascar refused to engage, Jordan said.

The Ultimate Motivation: Victory

Ultimately, the resistance against what he saw as a financially unsustainable model was driven by the familiar goal for Jordan: Success.

“Denny convinced me getting a third driver improved our chances to win,” he said, noting that he bought a third charter late in 2024 for $28 million amid the legal dispute. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her push for indefinite franchises, which she said a formal letter to Nascar. She testified the pressure of the contract signing demand didn’t sit well.

She said, the team founder first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. She said France replied, “Whether I have 20 charters, that’s what I have. If I have 30, I have 30.”
